SOCIAL SECURITY DISABILITY BENEFITS/SSD
When one faces the devastation of a disabling condition or injury and can no longer work and function normally, they may be entitled to disability benefits through the federal government.
The Social Security Disability and Supplemental Security Income programs provide assistance to people with disabilities. While these two federal programs are different in many ways, both are administered by the Social Security Administration and only individuals who have a disability and meet medical criteria may qualify for benefits under either program.
To qualify for Social Security Disability (SSD) benefits, the claimant must have worked in jobs covered by Social Security. They must have a medical condition or impairments that meet the federal regulation's definition of disability which requires that the claimant be unable to perform their past relevant work or any other work. Entitlement to SSD benefits also entitles a claimant to receive medicare coverage.
SUPPLEMENTAL SECURITY INCOME/SSI
Supplemental Security Income (SSI) is a Federal income supplement program funded by general tax revenues. It is designed to help aged, blind, and disabled people, who have little or no income; and provides cash to meet basic needs for food, clothing, and shelter. Eligible claimants also receive medicaid coverage. SSI is the disability program available to disabled children.
LONG TERM DISABILITY BENEFITS
Long term disability benefit policies are purchased from private insurance companies. The definitions and criteria of disability vary with the policy.
SHORT TERM DISABILITY BENEFITS
Short term disability benefits often precede long term disability benefits. The criteria and definitions of disability vary depending on the policy.
PERSONAL INJURY
Personal injury law involves cases where injured persons seek to obtain compensation for injuries sustained. For example, compensable injuries could arise from being involved in an automobile accident, motorcycle accident, slip and fall, use of a defective product, medical malpractice or nursing home negligence.
VETERANS DISABILITY BENEFITS
Veterans disability compensation is a benefit paid to a veteran because of service connected injuries or diseases that happened while on active duty, or were made worse by active military service. It is also paid to certain veterans disabled due to VA health care.
FLORIDA RETIREMENT DISABILITY
A state employee may qualify for such benefits if they are totally and permanently disabled. That means that they are prevented, by reason of a medically determinable physical or mental impairment, from rendering useful and efficient service as an officer or employee.
FEDERAL EMPLOYMENT RETIREMENT DISABILITY
To qualify for such benefits, a federal employee must, while employed in a position subject to FERS, have become disabled because of a medical condition, resulting in a deficiency in performance, conduct, or attendance, or if there is no such deficiency, the disabling medical condition must be incompatible with either useful and efficient service or retention in the position.
